Contract Information

As a dedicated and passionate photographer, I’m constantly looking for new moments to capture on camera. Since beginning my professional journey, I’ve worked on many different types of projects that have expanded my experience and added to my portfolio. As such, shoot appointments are in high demand and therefore it is important for me to communicate my expectations clearly to avoid disappointment.

Contract

Confirmation of Session

1.1-In order to confirm your booking, a $100 non-refundable retainer fee is required. 

​1.2-This retainer is then deducted from the total owing.

​1.3-The remainder is due within 1 week of shoot completion and before the images are finalized and delivered to the client. 

1.4-Failure to complete the full payment on time may result in additional late fees of 10% per week and late delivery of images.

1.5-The client must make payment in accordance with agreements. The client shall not receive final imagery until the payments are made in full.

Termination or Rescheduling

​2.1-The client can cancel the session at any time in writing, however this will result in forfeiture of retainer.

2.2- The client is financially responsible for any outlays that have occurred within this time and will be invoiced accordingly.

2.3-The customer can reschedule or postpone the session up to a maximum of 30 days without forfeiture of retainer.

Licensing 

3.1-Copyright is owned by Leigh Reynolds Photography. The Photographer grants the Client a license to use images and photographic works commissioned and selected by the client for purposes of advertising including in print and digital spaces.

Conditions of License

4.1-The license to use the photographs come into effect from the time that full payments is completed.

Copyright

5.1-All copyright remains with Leigh Reynolds Photography with no exceptions. The client acknowledges that they will have a license to use the images for a period of 5 years within New Zealand for print, point of sale, packaging, magazine and online advertising.

Indemnity

6.1-The Client undertakes to indemnify the Photographer for any loss, damage, or expense incurred due to a breach in the contract. The client indemnifies the photographer for any breaches in law occurring as a result of the shoot.

 Colour Variation

7.1-The Client acknowledges that photographic works may appear different in print than on screen depending on screen calibration and individual printer setting. The Client releases Leigh Reynolds Photography from any liability for any claim based on differing colours in imagery. 

 

Force of Nature

8.1-Neither the Client nor the Photographer shall be liable for any loss or damage arising directly or indirectly due to an act of God, fire, armed conflict, labour disputes, civil commotion, intervention of a government, accidents, interruption to transportation, weather or any other cause outside the Photographers control.

Additional Costings

9.1-The client is responsible for any cost involved in procuring additional items required specifically for the session, including but not limited to: ingredients, props, backdrops or equipment (if applicable, the customer will be made aware prior to the session commencing)

​​Retainer payment MUST BE MADE WITHIN 24 hours to confirm your session.

After this time, the booking will be re-open to other clients and you will need to to contact Leigh Reynolds Photography again to re-confirm your session is still available.
